Hainan Provincial Department of Commerce Functional Information
Article 1 This regulation is formulated in accordance with the "Guiding Opinions of the Central Committee of the Communist Party of China and the State Council on Supporting Hainan's Comprehensive Deepening of Reform and Opening-up" (Zhongfa [2018] No. 12) and the "Notice of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Issuing the "Hainan Province Institutional Reform Plan"" (Division [2018] No. 80).
Article 2: Hainan Provincial Department of Commerce (hereinafter referred to as the Provincial Department of Commerce) is a provincial government department responsible for internal and external trade, international economic cooperation, investment promotion and port management in the province. It is at the full-time department level and is equipped with the Hainan Provincial Port Office (hereinafter referred to as the Provincial Port Office).
Article 3 The main responsibilities of the Provincial Department of Commerce are:
(1) Implement the Party and the State's policies, laws and regulations on domestic and foreign trade, international economic cooperation, utilization of foreign investment, investment promotion, development of exhibition industry, and port management, as well as the policies and measures of the China (Hainan) Free Trade Pilot Zone and the Free Trade Port with Chinese characteristics, and implement the decisions and deployments of the Provincial Party Committee and the Provincial Government.
(2) Research and formulate and organize the implementation of development plans, laws, rules and policies for internal and external trade, international economic cooperation, utilization of foreign capital, investment promotion, headquarters economic development, exhibition industry development, and port management work in the province, study and put forward relevant opinions and suggestions, and implement Hainan's relevant work to serve the country's "Belt and Road" construction.
(3) Take the lead in exploring a more flexible policy system, regulatory model and management system for internal and external trade in the province, organize and implement trade facilitation reform measures, and coordinate the construction of a single window for international trade.
(4) Organize and implement anti-dumping, anti-subsidy, guarantee measures and other work related to fair trade in imports and exports.
(5) Responsible for the economic development of the provincial headquarters, the development of the exhibition industry, the development of e-commerce and the promotion of investment.
(VI) Responsible for coordinating the innovative development of service trade in the province; responsible for the management of the commercial service industry in the province.
(7) Guide the planning of wholesale markets (including spot bulk product markets) in the province, urban commercial outlet planning and commercial system construction, promote the construction of rural market systems, and organize and implement rural modern circulation network projects.
(8) Responsible for the regulation of important consumer goods markets and the management of the circulation of important means of production in the province.
(9) Guide the province's commercial credit sales and supervise and manage special circulation industries.
(10) Responsible for promoting the supply-side reform of the circulation industry in the province and promoting the construction of circulation standardization and the development of modern circulation methods.
(11) Responsible for managing the import and export trade of goods across the province, promoting trade liberalization and facilitation, supervising and coordinating the international bidding for mechanical and electrical products, and being responsible for the export control of dual-purpose items and technology.
(12) Responsible for the management and service of foreign-invested enterprises in the province, and guide the relevant work of national-level economic and technological development zones in the province.
(13) Responsible for the province's foreign economic cooperation and related foreign aid work.
(14) Responsible for comprehensively coordinating the management of ports across the province.
(15) Responsible for the application and implementation of various types of business development fund projects at the central and provincial levels.
(16) Guide the business work of Hainan International Economic Development Bureau.
(17) Complete other tasks assigned by the provincial party committee, provincial government and superior departments.
(18) Relevant division of responsibilities.
1. Division of responsibilities related to the Provincial Development and Reform Commission. The "Catalogue of Guidance for Foreign Investment Industry" was formulated by the Provincial Development and Reform Commission, together with the Provincial Department of Commerce and other departments, and jointly issued by the Provincial Development and Reform Commission and the Provincial Department of Commerce.
2. Division of responsibilities related to the Provincial Drug Administration regarding drug circulation management. The Provincial Department of Commerce is responsible for formulating the province's drug circulation development plans and policies, and the Provincial Drug Administration is responsible for the supervision and management of drug circulation, and cooperates with the implementation of drug circulation development plans and policies in drug supervision and management.
3. Division of responsibilities related to the Provincial Department of Tourism, Culture, Radio, Film and Television and Sports. The Provincial Department of Commerce is responsible for formulating and organizing the implementation of the provincial exhibition industry development strategies, plans, policies and standards; being responsible for the overall coordination, promotion and service of the exhibition industry; and being responsible for the daily work of the provincial joint meeting to promote the development of the exhibition industry. The Provincial Department of Tourism, Culture, Radio, Film and Television and Sports is responsible for coordinating the development of exhibition and tourism with the Department of Commerce.
4. Division of responsibilities with relevant provincial departments. The Provincial Department of Commerce is responsible for studying, formulating and organizing the implementation of the development plans, policies, measures, rules and regulations for investment promotion in the province, counting, evaluating and analyzing the investment promotion situation in the province, and taking the lead in planning, organizing and coordinating major investment promotion activities in the province; relevant provincial departments conduct industrial investment promotion based on their business functions.
Article 4 The Provincial Department of Commerce shall establish the following internal institutions:
(I) Office. Responsible for the daily operation of the department, responsible for meetings, secretaries, confidentiality, archives, petitions, office automation and logistics support; responsible for foreign business publicity, information comprehensiveness, and government affairs disclosure; responsible for comprehensive coordination of internal and external work of the department, supervision and inspection of relevant special or key work matters and supervision and inspection of the implementation of the department's annual work plan; responsible for compiling business briefs, business yearbooks, major events, historical records, etc.; responsible for the supervision and implementation of internal rules and regulations of the department; organize and coordinate poverty alleviation and rural revitalization work.
(2) Personnel Department (Talent Work Department). Responsible for the organizational establishment, personnel management and cadre and staff assessment and assessment of the department and its affiliated units; coordinate and organize cadre training; be responsible for the political review of the department and its affiliated units' overseas travel for official business and private overseas travel for private travel; be responsible for the meeting work of the department's party group; be responsible for poverty alleviation work; take the lead in the talent work and talent team building of exhibitions and other industries.
Work Department of Veteran Cadres. Works in conjunction with the Personnel Department and is responsible for the work of veteran cadres.
(III) Policies and Regulations Department. Organize the formulation of draft local laws and regulations in the field of business, be responsible for the review and filing of legality of normative documents, as well as the external signing of cooperation agreements and contract legal review; organize the formulation of the province's medium- and long-term plans for business development and annual work plans, take the lead in implementing comprehensive policies and measures for business development, and carry out business operation and development trend analysis; be responsible for annual and phased business work summary and drafting of important comprehensive materials; take the lead in promoting administration according to law and the construction of rule of law; undertake dispute cases involving law; be responsible for establishing a fair trade warning mechanism for import and export, guiding and coordinating the response to industrial security in our province; organize and coordinate the response and litigation of anti-dumping, counter-subsidy, guarantee measures and other trade relief investigations; be responsible for taking the lead in adjusting the list of business administrative law enforcement, guiding and supervising the comprehensive administrative law enforcement work in cities and counties in the field of business, and organizing and guiding the training of comprehensive administrative law enforcement in the field of business.
(IV) Free Trade Port Reform and Development Office. Take the lead in implementing the reform experiment tasks of the free trade zone (Hong Kong) promoted by this department; study and draft local regulations, government rules and normative documents in the business management field of the free trade zone (Hong Kong), establish and improve relevant regulations, policies and systems of the free trade zone (Hong Kong), and study and propose innovation paths and reform measures of the free trade zone (Hong Kong); be responsible for the liaison work of domestic and foreign free trade zone (Hong Kong); guide and coordinate cities, counties, departments (units) to implement relevant reform experiment tasks; undertake the daily work of the department's leading group to promote the construction of the free trade pilot zone (Hong Kong).
(V) Finance Department. Unified management of various types of special funds for business development allocated by the central and provincial levels, responsible for the organization of performance evaluation of special funds use, and conduct statistical analysis of special funds expenditures and project information; responsible for the organization of department budget preparation, daily accounting and department final accounts preparation and other financial management work; formulate relevant financial management systems; coordinate relevant departments such as finance, taxation, finance, and finance to implement funding policies and measures related to business work.
(VI) Audit Office. Responsible for the implementation of relevant major policies and measures by the Audit Department and its affiliated units, the implementation of relevant development plans, annual business conditions, as well as financial revenue and expenditure, major investment projects and other related economic activities; responsible for auditing the performance of economic responsibilities of the heads of the internal institutions and affiliated units; responsible for the soundness and effectiveness of the audit internal control system and risk management; assisting in the handling of audit matters entrusted by the auditing authority.
(7) Investment Promotion Department (Provincial Investment Promotion Bureau). Formulate and organize the implementation of the provincial investment promotion work plan; count, evaluate and analyze the province's investment promotion situation; take the lead in planning, organizing and coordinating major investment promotion activities in the province; organize and coordinate the province's investment promotion work, and carry out provincial investment promotion business training; formulate provincial policies to promote the economic development of headquarters, and organize the registration, statistics, and analysis of headquarters enterprises; cooperate with relevant departments to supervise and inspect the investment soft environment, and coordinate the resolution of investors' complaints; undertake the daily work of the joint meeting of the Provincial Free Trade Zone (Hong Kong) investment promotion work and the promotion of headquarters economic development.
(8) Exhibition and Exhibition Office (Provincial Congress Exhibition Bureau). Formulate and organize the implementation of the provincial exhibition industry development strategies, plans, policies and standards; be responsible for the overall coordination, promotion and service of the exhibition industry; undertake the statistics, evaluation, training and external publicity and promotion of the exhibition industry; coordinate and guide the introduction and cultivation of brand exhibition activities and exhibition enterprises; guide the planning and construction of exhibition facilities and exhibition pavilions; undertake the daily work of the provincial joint meeting to promote the development of the exhibition industry.
(9) Service Trade Department (Provincial Service Trade Promotion Bureau). Formulate and organize the implementation of the provincial service trade development plan and policy measures, monitor, analyze, publish and manage the provincial service trade statistics; be responsible for coordinating service trade training, legal aid, external publicity and promotion and investment promotion; be responsible for managing special funds for service trade development; undertake the daily work of the Provincial Service Trade Innovation and Development Joint Conference.
(10) E-commerce Office. Formulate and organize the implementation of the province's e-commerce development strategies, plans and policies; be responsible for promoting the development of e-commerce transaction service formats; guide the e-commerce application of enterprises in the province; cultivate key e-commerce enterprises and platforms, support small and medium-sized e-commerce enterprises; promote the construction of e-commerce industrial parks; promote the province's e-commerce in rural areas and e-commerce poverty alleviation work; carry out statistics, monitoring and analysis of the e-commerce industry; take the lead in promoting the application of e-commerce in various industries, coordinate the development of supporting industries such as distribution, payment, technology, and certification; promote cross-border e-commerce work.
(11) Consumption Department (Provincial Consumption Bureau). Responsible for the monitoring and analysis of the market operation of daily necessities, important consumer goods and important means of production in the province, as well as the prediction and information guidance of abnormal market fluctuations; take the lead in doing a good job in statistical analysis of the commercial circulation industry; be responsible for the promotion of consumption in the province's business field, formulate policies and measures to promote consumption in the business field, organize and carry out provincial consumption promotion activities, and predict and analyze the operation of the consumer market in the province; be responsible for the management of refined oil circulation in the province; be responsible for the statistical work of the cocoon silk industry in the province; be responsible for the supervision and management of direct sales and single-purpose commercial prepaid cards; be responsible for the management of the life service industry of residents Responsible for monitoring, analyzing, publishing and managing statistical data of residents' life service industry in the province; responsible for coordinating the standardization, branding and international promotion of residents' life service industry in the province; responsible for the province's commercial franchise, brand building, time-honored brands, auction management and other related work; cooperate with the promotion of duty-free consumption policies, statistically analyze duty-free shop business data; guide the innovation of the physical retail industry and the management of smart business districts (smart shops); formulate the development plan of the drug circulation industry, do a good job in related statistical work, and cooperate with the implementation of the national basic drug system; be responsible for the supervision of bulk cement application.
(12) Market System Construction Department. Research and put forward local legislative suggestions for the construction of the market system and the development of urban and rural markets within the province, draft relevant local regulations and government regulations, and formulate relevant policies; coordinate the coordinated development of urban and rural markets across the province, guide the planning, commercial system construction and community commercial development, standardize the development of large-scale commercial projects and commercial clusters, guide and supervise the planning and construction and transformation of farmers' markets across the province, promote the construction of rural market systems, and optimize the layout of commercial outlets in rural and small and medium-sized towns; promote the construction of agricultural product circulation systems and promote the connection of production and sales; formulate the planning of wholesale markets within the province (including spot bulk product markets) and promote the construction of various markets; manage the circulation of automobiles (including used cars and scrapped cars), and the second-hand automobile market The circulation industry conducts supervision and management; guides and supervises the recycling and dismantling of used cars in the province; takes the lead in implementing the work of the provincial government to stabilize vegetable prices; is responsible for promoting the construction of business integrity and establishing a public service platform for business integrity; promotes the construction of an industry credit system, and guides industry associations to implement industry self-discipline; organizes the construction of important product traceability systems and undertakes the daily work of the joint meeting on the construction of important product traceability systems in the province; promotes the construction of commercial logistics systems and promotes the development of emerging business formats such as logistics distribution and supply chain management; guides the development of green circulation and energy conservation and consumption reduction in the circulation field; formulates and organizes the implementation of policies and development plans for recycling and old goods circulation industries; takes the lead in organizing production safety work in the business field of the province.
(13) Enterprise Service Office (Administrative Approval Office). Responsible for coordinating the work of optimizing the business environment in the business field, researching and proposing measures to optimize the business environment in the business field, supervising, inspecting and evaluating the construction of the business environment in the business field; taking the lead in implementing the work tasks of the provincial joint meeting on optimizing the business environment; being responsible for the contact and services of key projects and key enterprises in the business field, and coordinating and solving problems reported by enterprises; being responsible for the contact and communication of social groups such as industry associations and chambers of commerce and industry management; being responsible for the management of Hainan Free Trade Port investment promotion website and investment service platform; taking the lead in organizing and implementing the provincial investment promotion assessment work; being responsible for the administrative approval work of this department, and adjusting the approval authority in the business field.
(14) Foreign Trade Office. Responsible for providing business guidance to the province's foreign trade industry and promoting trade transformation and upgrading; responsible for the management of import and export commodity quota, guide the construction of export product bases, and promote the standardization of export trade; guide the construction of foreign trade promotion system and the development of foreign trade market; responsible for the import and export and processing trade management of state mechanical and electrical products, high-tech products and complete sets of equipment; responsible for border trade management.
(15) Foreign Investment Management Office. Formulate and organize the implementation of policies and measures to promote foreign investment in the province, guide and coordinate the promotion of foreign investment, and coordinate the construction of a foreign investment environment; study and analyze the situation of foreign investment in the province, organize and implement joint annual inspections of foreign investment enterprises, and be responsible for foreign investment data statistics; be responsible for the promotion, contact, tracking, coordination and service of major foreign investment projects in the province; plan and organize overseas investment promotion work, organize enterprises to participate in relevant overseas investment promotion; undertake foreign investment promotion and tracking services for major projects, and organize Hainan's overseas business representatives to carry out related work; guide national-level economic and technological development zones in the province to carry out exchanges, cooperation and functional docking, etc.; be responsible for the relevant management of overseas non-governmental organizations; take the lead in guiding the business work of Hainan International Economic Development Bureau.
(16) Department of Foreign Investment and Economic Cooperation. Formulate and organize the implementation of the province's foreign economic cooperation, foreign investment and outbound employment plan; strengthen international cooperation in the construction of the "Belt and Road" and promote enterprises to "go global"; manage and supervise the province's foreign engineering contracting, labor cooperation, design consulting and national foreign aid business, and be responsible for the protection of the rights and interests of foreign labor and overseas employment personnel; review the business qualifications of domestic enterprises' foreign investment and start enterprises (except financial enterprises) and foreign economic cooperation enterprises; undertake statistics on foreign direct investment, foreign contracting projects and labor cooperation; organize the application for the use of international free aid projects in the province and organize supervision and inspection; carry out other international cooperation and exchange activities; organize domestic economic cooperation and exchange activities.
(17) Port Development Department. Responsible for the research and formulation of port policies and systems; formulate port layout and development plans; be responsible for port operation data statistics and analysis; be responsible for port comprehensive performance evaluation; supervise and guide the work of municipal and county ports; be responsible for international cooperation, external publicity and exchanges at ports.
(18) Port Management Office. Supervise and guide the construction of port inspection infrastructure projects; be responsible for the declaration, acceptance, closure of ports and other work and formulate relevant systems; be responsible for the review and approval of temporary opening of ports, docks, waters and airports; be responsible for the temporary activation of new terminals and berths within the port; coordinate and promote the declaration of designated supervision sites for customs; be responsible for the management of direct freight vehicles for Hong Kong and Macao.
(19) Port facilitation office. Responsible for optimizing port customs clearance processes; implementing national cross-border trade facilitation action measures; promoting port customs clearance facilitation reform, studying and organizing and supervising relevant departments to implement specific measures; coordinating the promotion of port customs clearance, regional customs clearance cooperation mechanism and other related work; supervising and coordinating customs clearance service guarantee work for major activities; and coordinating the promotion of joint port law enforcement work.
(20) Port Information Department. Coordinate the needs of port information construction and formulate port information construction plans; be responsible for the application and promotion of Hainan's "single window" and port-related public service platforms; organize and implement Hainan's "single window" operation and maintenance services and data security work; coordinate and promote port data sharing.
(21) Party Committee of the Organization. Responsible for the party building and discipline inspection work of the organs and affiliated units, and leading the work of mass organizations such as trade unions, the Communist Youth League, and the Women's Federation of the organs.
Article 5 The Provincial Department of Commerce has 132 administrative staff. There is one director and three deputy directors (one of whom is also the director of the Provincial Port Office). There are 52 department-level leadership positions, including 22 full-time deputy secretary of the Party Committee of the Organization and 1 director of the veteran cadre work department), and 30 deputy department-level officials.
Article 6 The establishment, responsibilities and staffing matters of public institutions affiliated to the Provincial Department of Commerce shall be separately stipulated.
Article 7 The provincial party committee shall be responsible for interpreting these regulations, and the specific work shall be undertaken by the Office of the Provincial Party Committee Organization and Staffing Committee, and the adjustment shall be handled by the Office of the Provincial Party Committee Organization and Staffing Committee in accordance with the prescribed procedures.
